1 | Acceptance of Terms
Welcome to Clark Outdoor Products Online Services. Clark Outdoor Products (hereafter COP) provides its service to you, subject to the following Terms of Service (“TOS”), which may be updated by us from time to time without notice to you. You can review the most current version of the TOS at any time at: www.junglehammock.com/terms-of-service. In addition, when using www.junglehammock.com/ you shall be subject to any posted guidelines, disclaimers or rules applicable to its services which may be posted from time to time without notice. All such guidelines, disclaimers or rules (including but not limited to our Hammock sales) are hereby incorporated by reference into the TOS.
2 | Description of Online Service
COP sells camping hammock products and other products over the internet. COP reserves the right to sell products at a discount to some customers, but a discounted product does not fall under COP’s guarantee which entitles a customer to a partial refund if a customer returns a hammock within 14 days of purchase (further customer obligations when returning a product are stated hereafter in the paragraph with the heading “Obligations”). Gift Cards that were purchased for a discount are not elegible to be used with other offers and discount codes. COP reserves the right to retain products without refunding their sale price to a customer if the customer refuses delivery of the product. COP reserves the right to not fulfill its obligations related to shipping hammocks that you purchase should the required data in its shopping cart or ordering pages not be complete, or if technical difficulties (such as but not limited to e-mail defects, glitches or problems) be present at the time of ordering.
3 | Description of “Business Days” and Shipping Terms
You understand that COP does not provide services including shipping on non-business days. You understand “business days” to signify any days that are not Saturday, Sunday, a national holiday of the United States of America, a Utah state holiday, the day after Thanksgiving and December 24.
4 | Obligations
In consideration of your use of the COP Online Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the shopping cart and ordering pages (including but not limited to your name, credit card number, phone number, and e-mail address). If you provide any information that is untrue, inaccurate, not current or incomplete, or COP has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, COP has the right to suspend or terminate your account and (or) order and refuse to you any and all current or future use of COP online services. (b) never request a refund for shipping services when returning a product. (c) never request a refund for a discounted product or any product sold as part of a special offer since a discounted product is not guaranteed by COP for refund and by using a discount code you are agreeing to not return the product. (d) never request to return a product unless doing so by notifying COP within 14 business days of the delivery date of your order by calling 1 800 468-4635 or emailing firstname.lastname@example.org. (e) when returning a product, make certain that a returned item arrives at COP’s Murray, Utah factory within 10 days of notifying COP of a return. (f) include orginal invoice with returned goods. (g) accept up to a 30% re-stocking fee which COP will charge on the original sale price of returned goods (h) take full responsiblity for any customs fees, duties, or taxes which are charged to you when receiving a product from COP. (i) return a product you believe to be flawed within 10 days of receiving it to Clark Outdoor Products 4403 S. 500 W. SLC, UT 84123. (j) allow COP to determine whether a product returned because of a flaw actually has a flaw or not, and, if not, request no refund for the shipping charges incurred when sending the product to COP. (k) exchange opened products for only full-priced items (l) never return a product or request a refund if you have purchased Clark products in the past (l) accept up to a $40 shipping fee when returning products that were shipped to you for free (m) allow up to 10 weeks for items to be refunded through the same method you used to pay for them (n) accept the end of your trial period if you ask for a returned item to be sent back to you (0) allow 21 days for refunds after an item reaches our facility for return-processing .
6 | General Information
The TOS constitute the entire agreement between you and COP and govern your use of the Online Service, superceding any prior agreements between you and COP. The TOS and the relationship between you and COP shall be governed by the laws of the State of Utah without regard to its conflict of law provisions. You and COP agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Salt Lake, Utah. The failure of COP to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provisions, and the other provisions of the TOS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the TOS are for convenience only and have no legal or contractual effect.
7 | Violations
